These Terms and Conditions establish a contractual relationship governing the conduct, responsibilities and rights of you (hereinafter “the clients”) and Christodoulos Eleftheriou (hereinafter the “service provider”) in order to regulate the lawful, proper and safe provision of tennis instruction and/or lesson services (hereinafter the “Services”).
Each client shall comply with any and all provisions of these Terms and Conditions, Policies, Instructions and/or Guidelines (hereinafter referred to as the “Regulations”) governing the provision of the Services as they may be adopted and/or updated from time to time.
1. Definitions
- “Service Provider” means Christodoulos Eleftheriou, including any authorised assistants or substitute instructors engaged by him.
- “Client” means any person who books or receives the Services.
- “Minor” means any Client under the age of eighteen (18).
- “Services” means tennis instruction, coaching sessions, training programmes, fitness preparation and any related activities offered by the Service Provider.
- “Session” means each scheduled appointment for the provision of the Services.
- “Website” means any website, booking platform or online service operated by the Service Provider.
- “Equipment” means all tennis, fitness, training, or safety equipment used during the Services.
2. Obligations of the Clients
- i. Respect and observe the general safety rules and/or instructions and/or guidance by the service provider and/or the fire safety rules and/or any other rule and/or regulation applicable at the place where the Service may be provided.
- ii. Observe the personal hygiene rules.
- iii. Keep themselves informed of the current Regulations as may be updated from time to time and published on the website of the service provider and/or are made available and/or known to them by the service provider.
- iv. Wear the necessary and/or appropriate clothing for exercise (i.e. sportswear and sport shoes).
- v. Follow the relevant training guidelines depending on his/her fitness level.
- vi. Abstain from any action and/or exercise that exceed his/her endurance, fitness and/or strength levels.
- vii. Keep the place where the Services are provided clean and/or at the same condition that it was found at the beginning of each Service session.
- viii. Use the equipment as indicated by the service provider.
- ix. Take all reasonable measures to avoid accidents, including but not limited to:
a) Minimization, whenever possible, of telephone calls and/or mobile phone use while receiving the Services.
b) Leave any equipment use for the Services unattended. - x. Arrive at the place where the Services are to be provided at least 15 minutes prior to the time when the session commences.
- xi. Notify the service provider of any cancellation of an agreed and/or booked Service session at least 12 hours prior to the commencement of the Services.
- xii. Pay the agreed fee at the booking of each Service session.
- xiii. Provide during the use of the service provider’s website all the necessary personal information and/or contact details and/or medical information and/or payment details.
- xiv. Indicate any emergency contact if requested to do so by the service provider.
- xv. Use the machines, equipment and other property of the service provider and/or any third party with due care.
- xvi. Each guardian and/or parent must accompany and supervise his/her minor child throughout the child’s training and/or receipt of Services, taking responsibility for the child’s behaviour during the provision of the Services.
3. Health and Medical Fitness
- i. The Client represents and warrants that he/she is physically fit to participate in the Services and has no medical condition that may limit or affect safe participation.
- ii. The Client shall immediately inform the service provider of any injuries, illnesses, physical limitations, or medical conditions that may affect participation.
- iii. The Client acknowledges that participation in physical activity carries inherent risks and voluntarily assumes all risks associated with the Services, except where caused by the service provider’s gross negligence or wilful misconduct.
- iv. The Client is solely responsible for seeking medical advice prior to engaging in the Services if unsure of his/her physical condition.
4. Client Acknowledgement
- i. They may be charged the full fee of each Service session if they fail to notify the service provider of any cancellation at least 12 hours prior to the commencement of the Service session.
- ii. They are responsible for making the necessary arrangements to arrive at the place where Services are to be provided on time.
- iii. They are responsible for bringing all necessary equipment required for the Services, unless otherwise indicated by the service provider.
- iv. Services may be cancelled at any time prior and/or during their provision in the event of any unforeseen circumstances including but not limited to weather conditions and/or illness and/or strikes and/or any other act of God.
- v. The service provider may alter the booking fee for the provision of Services at any time for which you will be notified via the service provider’s website.
- vi. Changing clothes is allowed only in the changing rooms when these are available at the place of provision for the Services.
- vii. Unless the service provider, in his sole discretion, decides otherwise, no money refunds are applicable.
- viii. The client is solely responsible for the safety of all of the personal belongings they choose to bring with them during the provision of the Services. The service provider assumes no responsibility for any lost and/or damaged personal items.
- ix. The service provider bears no responsibility for any accidents during the provision of the Services caused at the client’s fault.
- x. The client may be required to indemnify the service provider and/or any third party for any damage caused by the client during the provision of the Services.
5. Prohibitions and/or Restrictions
- i. Using and/or transporting and/or holding of any sharp and/or flammable and/or dangerous and/or other kinds of prohibited objects and/or substances during the provision of the Services.
- ii. Consuming any food and/or alcoholic beverages during the provision of the Services.
- iii. Animals and/or pets are not allowed during the provision of the Services.
- iv. Using aggressive language and/or any other inappropriate and/or aggressive and/or reckless behaviour during the provision of the Services and/or while the client is at the place where the Services are provided.
- v. Making excessive and/or unreasonable noise, as determined based on the service provider’s judgement.
6. Other Rights and Responsibilities
- i. The service provider has the right, in his sole discretion, to refuse any client from participating in any aspect of the Services and/or from the use of equipment in view of the client’s physical condition and/or due to his/her behaviour or non-compliance with the Regulations.
- ii. The client shall be solely responsible to pay compensation for any breaking and/or destruction of and/or damage to the equipment and/or the place of provision for the Services, provided that it was caused by him/her.
7. Limitation of Liability
- i. To the maximum extent permitted by law, the service provider shall not be liable for any injury, loss or damage suffered by the client arising out of or in connection with the Services, except where such injury, loss or damage is caused directly by the service provider’s gross negligence or wilful misconduct.
- ii. The service provider shall not be liable for injuries arising from:
a) normal and foreseeable sporting risks inherent in tennis and fitness activities;
b) improper use of Equipment;
c) failure to follow instructions;
d) actions or omissions of third parties. - iii. In all circumstances, the service provider’s total liability shall be limited to the amount paid by the Client for the specific Session during which the incident occurred.
- iv. Nothing in these Terms limits liability for death or personal injury caused by gross negligence.
8. Conduct and Behaviour
- i. The Client shall behave respectfully and follow all instructions issued by the service provider.
- ii. The following conduct is strictly prohibited and may lead to disciplinary action:
a) harassment, threats, abusive language or aggressive behaviour;
b) discrimination or inappropriate conduct;
c) reckless or dangerous actions;
d) intentional misuse of Equipment;
e) unauthorised filming or photography of other clients. - iii. Disciplinary action may include:
a) verbal warning;
b) suspension from a Session;
c) permanent termination of Services without refund in serious cases.
9. General Provisions
- i. In case of violation of any of the terms and/or regulations contained herein and/or any other instruction provided by the service provider, the service provider reserves the right, in its sole discretion, to cancel the client’s membership and/or refuse to provide his Services in the future, without prior notice and without any refund. In such a case, the client automatically waives his/her rights to any compensation and/or remedy.
- ii. In no case shall any waiver of rights on the part of the service provider with respect to the Regulations and/or any omission or breach thereof constitute a waiver and/or omission of any other rights and/or any future breach.
- iii. Where the term “client” refers to more than one person, the singular shall be construed in the plural, and the obligations and responsibilities of such persons shall be construed in accordance with these Regulations.
- iv. In the event that one or more of the provisions of these Regulations is deemed unlawful, this shall not affect the validity of all other provisions.
- v. The service provider does not guarantee the performance of any third party, including but not limited to the owner of any place where the Services are to be provided.
- vi. The service provider disclaims, to the maximum degree permitted by law, all liability for any indirect, incidental, special, or consequential damages arising from the use of the Services.
10. Cancellation by the Service Provider
- i. The Service Provider may cancel or reschedule a Session due to:
a) adverse weather conditions;
b) illness or injury of the instructor;
c) unavailability of the training venue;
d) any other event of force majeure. - ii. The Client will be notified as soon as reasonably practicable.
- iii. Where a Session is cancelled by the service provider, the Client shall be offered either:
a) replacement Session, or
b) credit for future use. - iv. Refunds shall only be issued at the service provider’s discretion.
11. Equipment Use and Responsibility
- i. Clients shall use Equipment only as instructed by the service provider.
- ii. The Client must inspect Equipment before each use and report any defects immediately.
- iii. The Client shall be responsible for any loss, breakage or damage caused intentionally or through improper use.
- iv. The service provider may charge the Client for the repair or replacement value of any damaged Equipment.
12. Minors
- i. A Minor may only participate in the Services with the written consent of a parent or legal guardian.
- ii. The parent or guardian must remain present and supervise the Minor throughout all Sessions unless expressly agreed otherwise.
- iii. The parent or guardian accepts full responsibility for the Minor’s conduct, safety, and compliance with these Terms.
- iv. The service provider may refuse participation by a Minor if he considers that the Minor poses a safety risk to themselves or others.
13. Payment Terms
- i. The client shall pay the full Session fee at the time of booking unless agreed otherwise in writing.
- ii. Accepted payment methods include cash, bank transfer, online payment, or any other method indicated by the service provider.
- iii. All fees are exclusive of VAT and/or any other applicable fee and/or levy and/or tax unless expressly stated otherwise.
- iv. Where packages or monthly subscriptions are offered, they are subject to the specific terms communicated at the time of purchase.
- v. Late payments may incur an administrative charge of €XXX per day and may result in refusal of Services.
- vi. The service provider reserves the right to refuse further bookings until outstanding payments are settled.
14. Confidentiality and Data Protection
- i. The service provider processes personal data in accordance with the General Data Protection Regulation (GDPR) and Cypriot data protection laws. - ii. Client data will be handled securely and will not be shared with third parties without consent, except as required by law or if otherwise provided in the privacy policy.
- iii. The service provider is not responsible for any data breaches caused by third parties, cyberattacks, or external threats.
15. Dispute Resolution
- i. Any disputes arising from our services shall first be addressed through negotiation.
- ii. The service provider retains his right to seek legal recourse through Cypriot courts if necessary.
16. Intellectual Property
- i. Any content that the service provider makes available on or through the Website, including proprietary content and any content licensed or authorized for use by or through the service provider from a third party (hereinafter "service provider Content") belongs or is licensed or authorised for use of the service provider.
- ii. The Website and the service provider Content may in its entirety or in part be protected by copyright, trademark, and/or other laws of Cyprus and other countries. You acknowledge and agree that the Website and the service provider Content, including all associated intellectual property rights, are the exclusive property of the service provider and/or his licensors or authorizing third parties.

18. Amendments to Terms

- ii. Continued use of our Services after amendments constitutes acceptance of the revised Terms.
19. Disclaimer of Warranties
- i. The service provider provides his services "as is" and "as available" without any warranties, express or implied.
- ii. The service provider does not warrant that our services will be error-free, uninterrupted, or free from defects.
- iii. The service provider disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement.
- iv. No information obtained from the service provider shall create any warranty not expressly stated in these Terms.
